Divorce

Board Certified Raleigh Divorce Lawyers

Our family law practice group includes four experienced and well-known divorce attorneys who work primarily in Wake County in the areas of divorce, child custody, and family law. Three of the divorce attorneys are trained as mediators, and one is a certified mediator.  Each is a frequent speaker at continuing legal education classes for divorce and is well regarded by the local and North Carolina State Bars.

These are questions we often receive from clients who contact us regarding their divorce matter. The brief answers we provide are intended as a broad overview and are not intended to serve as legal advice. Contact the law offices of Herring Mills & Kratt PLLC, to schedule a consultation to discuss your divorce questions.

What is a Board Certified Specialist in family law?

To be certified as a specialist by the North Carolina State Bar, a lawyer must have expertise in the specific area. Particularly he/she must:

  • Be an active member in good standing with the North Carolina State Bar for at least five years
  • Devote at least 25 percent of his or her practice to the specialty during the past five years
  • Attend at least 12 hours of continuing legal education seminars in the specialty area each year
  • Receive favorable recommendation from other lawyers and judges
  • Pass a written examination in the specialty practice area
  • Be recertified every five years.

Parker Herring Bobby Mills, and Anna Worley hold board certification as Family Law Specialists.

What should I expect my divorce to cost?

It is impossible to determine in advance how much time will be needed to handle your divorce. If issues of spousal support, community property division, and child visitation rights require litigation, divorce cases can become lengthy.

We charge an initial consultation fee of $250, which is due at the time of the consultation. During the consultation, the attorney will discuss with you North Carolina law and how it applies to the law in your case. Our attorneys work with fee advances ranging from $3,000 to $10,000 depending on the nature and complexity of the case. Some matters such as uncontested divorces and uncontested separation agreements are billed on a flat fee basis.

Can't my ex-spouse be ordered to pay my attorney's fees?

Sometimes, but not always, the Court will order reimbursement of part or all of a client’s attorney’s fees and expenses. Because awards of attorney’s fees are uncertain, you will be responsible for payment of all attorney’s fees and expenses up front.

Will my divorce necessarily end up in an expensive court battle?

As family law attorneys and trained mediators, we are committed to minimizing your emotional and financial costs and will work to settle your case without litigation. But we will aggressively protect your interests and take your case to court if mediation and settlement negotiations fail.
